The Text

Article I: Purpose

The Carthian Collective of the city of Atlanta (heretofore "the Collective") endeavors to provide many privileges for its members. These are included but not limited to the following. Section 1. The Collective intends to provide for the well-being of its members. Section 2. The Collective intends to provide the legal framework for requests for security, and will attempt within its power to provide such security as it is deemed warranted. Section 3. The Collective intends to provide a regular forum for open debate and the determination of consensus, at least once every two weeks. Section 4. The Collective intends to provide political representation and advocacy on behalf of its members, within the city of Atlanta. "Section 5." The Collective shall strive, in all ways, to provide the framework of self-growth of its members through Collective Action.


Article II: Duty

The Collective maintains certain standards for of action for its membership, and reserves the explicit right to expel those who are unwilling to comply with the following conditions. This list does not contain all expectations for membership, and extenuating circumstances may exist. Consensus makes the final decision as to a member's expulsion. Section 1. Members of the Collective are expected to attend debates at least semi-regularly, and bring ideas and innovation to such. Section 2. Members of the Collective are expected to contribute to Collective resources as needed. Section 3. Members of the Collective are expected to report promptly on serious incidents they are involved with within the city. Section 4. Members of the Collective are expected to follow the consensus they create, including the directives of the executive officers they help put in place via consensus.

Article III: Structure

The Collective's Executive Branch consists of the office of the Prefect, the Judicial Branch consists of the office of the Myrmidon, and the Legislative Branch (heretofore called "the Senate"), which shall consist of the remaining members of the Collective "in good standing"). Minor offices and posts within the Collective shall come, as needed, from the ranks of the Senate and such positions shall not supercede one's rights or obligations to the Senate.

Section 1: The Prefect

The Prefect handles external covenant affairs and sets internal policy for the Collective. These include the following. Subsection 1. The Prefect may use Collective resources, in emergency circumstances, to deal with the emergency circumstances in question. This is not a power to be used lightly, and such can and will be reviewed by consensus after the incident. Subsection 2. The Prefect may call emergency Collective meetings to deal with urgent issues Subsection 3. The Prefect decides the primary topics of debate during the biweekly open forum, and the order in which they are discussed. This may be overruled by consensus of the Collective. Subsection 3a. The Prefect moderates debates. Subsection 4. The Prefect may call emergency Collective meetings to deal with urgent issues. Subsection 5. The Prefect serves as the covenant's ambassador, and may negotiate treaties, but not ratify them. "Subsection 6." In cases where the vote of the Senate / Collective is deadlocked, the Prefect's vote may be considered the deciding vote. Should the vote of the Prefect be in confict of interest or disallowed (see Senate Powers), the vote of the Myrmidon may be used as the deciding vote. Subsection 7. The Prefect shall hold the power of veto to any law, ammendment or policy change voted on by the Senate

Section 2: The Myrmidon

The Myrmidon handles the Collective's internal affairs, dispute resolution, and security. Subsection 1. Like the Prefect, the Myrmidon may use Collective resources, in emergency circumstances, to deal with the emergency circumstances in question. This is not a power to be used lightly, and such can and will be reviewed by consensus after the incident. Subsection 2. The Myrmidon coordinates long-term, covenant-spanning projects set out by the Collective. Subsection 3. The Myrmidon mediates disputes between Collective members. Subsection 4. The Myrmidon mediates disputes between members and non-members. Subsection 5. The Myrmidon may make the resolution of any dispute brought to his or her office binding in all ways, in that the decision is final and cannot be appealed. By appearing before the Myrmidon, both parties consent to accepting his judgment. Subsection 6. The Myrmidon is empowered to call witnesses and examine evidence as needed. Subsection 7. The Myrmidon is responsible for ensuring directives of the Collective, the Senate, or the Prefect have been carried out by the members of the Collective. This power also extends to the dispensing of legal remedies set forth by the Collective, the Senate, or the Prefect.

Section 3: Senate

The Senate shall comprise of the entire acknowledged membership in good standing of the Collective, except for the exectutive branch. Subsection 1. The duty of the Senate (as opposed to the whole collective) is to propose new laws, ammendments, and policies via concenus and to ratify laws and policies proposed by the executive branch of the Collective. Subsection 2. The Senate shall act as the will of the Collective. Upon a two-thirds majority vote, the Senate may overturn any law, ammendment or policy set forth by the Executive Branch that is not in accordance with the general will of the Collective. Subsection 3. The Senate shall be the balance of power to safeguard the Collective from abuse of power. Upon a two-thirds majority vote, the Senate has the power to call for a Non-Confidence Motion of a member of the Executive Branch. If such a Motion passes, it is to go before the entire Collective (save for the target of the motion who must declare 'Conflict of Interest') for concenus.

Section 4: Minor Offices

Minor offices or positions shall come from the ranks of the Senate and promotion to those offices or positions shall invalidate membership to the Senate. These positions shall be created as needed, to fill roles required by the Collective, as needed. The creation of such offices or postions need not be ammended into the Constitution, but must be approved by either the Prefect, the Myrmidon, or by a concensus of the Senate. One example of such an office would be that of the Exchequer who would serve to record and catalog the Movement’s resources, boons and its areas of influence. Another example would be that of the Deputy, whose role would be to both assist the Myrmidon and act as a go-between if needed. This office serves to investigate claims of either harming the Movement or a fellow Carthian. They may also initiate investigations on their own, to ensure the common interest is kept by all. This office may not carry out punishment or sentence without the expressed and explicit approval of the Senate and / or the Myrmidon.

Section 4

The Pleblican shall be composed of those members of the Collective who either lack status and standing within the Collective, or for whatever reason, have been stripped of standing within the Senate. Subsection 1. A Pleblican shall have the right to particpate in debates and in helping form concensuses within the Collective, however, no pleblican may partake in the Senate nor hold any office - minor or otherwise. "Subsection 2." A Pleblican shall hold all the rights, security, and obligations expected of any member of the Collective

Article IV

The Collective makes non-urgent, non-executive decisions via a process of consensus of the Senate at the biweekly meetings, which all members of the Senate (entire Collective save for the Prefect, Myrmidon, and Pleblicans) are tallied in. Consensus is not a vote, and not unanimous, but instead is the process of coming to agreeable compromise. The circumstances that merit the consensus of the Senate include the following. Section 1. Members will be admitted or dismissed by consensus. Section 2. Officers will be selected and removed from their positions by consensus. Section 3. This constitution may be amended by consensus. Section 4. Consensus has the power to ratify inter-covenantal treaties negotiated by the Prefect. Section 5. War may be declared for a specific purpose alone, only via unanimous consensus. It may be ended prematurely by non-unanimous consensus. "Section 6." Should any critical concenus issue of the Senate be deadlocked, the Senate may turn to either the Myrmidon or Prefect to decide on the issue, depending upon whose role the concenus falls under. "Section 6" The Prefect holds the power of veto over any concensus of the Senate, to be used sparingly and only in the most dire circumstances.
